Overview:
An expatriate client unexpectedly found themselves facing a civil lawsuit in a foreign jurisdiction. The case was filed locally, even though the court had no proper authority to hear the matter. This posed a serious threat to the client’s financial interests and reputation abroad.
Our Approach:
Understanding the logistical challenges of international litigation, we immediately executed a remote Power of Attorney (POA) to represent the client without requiring their physical presence. We then sought an injunction to pause proceedings and filed a jurisdictional challenge highlighting the court’s lack of territorial authority.
Result:
After reviewing our submissions, the court dismissed the case on jurisdictional grounds, confirming that the claim was improperly filed. The client was spared unnecessary litigation costs and the stress of a prolonged legal battle.
Key Takeaway:
For expatriates, swift legal representation and jurisdictional expertise are essential to prevent misuse of local legal systems.
